ABC we would like to thank all the committee members for all their efforts during the year . Both Howard and myself have stated on many occasions that you are not to blame for the debarcle over the past 12 months You have been used by Gary Robb to keep us all quiet , he knows full well that none of the buyers would "have a go" at any of you, because we all know you are doing the very best you can under very difficult circumstances. Gary is arrogant, he cares nothing for the welfare of any others than himself and his immediate family  He blatantly refuses to give any explanations , he refuses to give any kind of time scale for completion of all our properties He blames other people for him not keeping his word that he would complete Amaranta by Jan 2009, he was continually asked where he was getting the money and he told us to mind our own business , how he got the money was his business now he has failed its somebody else s fault at no time when he realised that he was not getting the money did he say to the buyers "i am having a problem , suspend your payments until i sort it out"-(-i am stupid , because that would only be the action of a honourable person ) You say you have received £1,181,484 and spent £1,180550 ,leaving the princely sum of £934 in the bank Gary has still not provided any details of how this money has been spent no invoices or proof All we got was a list of expenditure that a schoolboy could have concocted(and that is being derogatory to the schoolboy) eg; reading from list supplied Diesel                   £6000 Steel Labour         £8000 Stone                    £16000 Water                   £5000 Staff                      £15000           these are just a few but all nice round figures thought up on the back of a fag packet all nicely adding up to the money we have sent. Just for information for ALL AGA buyers the amount of money received by AGA from buyers prior to the payments made during the past 12 months i am informed is ,as follows:   AMARANTA                                        £10,176,608 OTHER AGA SITES                             £  8,583217  TOTAL                                                £18,759,825 WHERE HAS ALL THIS MONEY GONE???? Which brings me to the next unanswered question . when ABC say that Gary has had to have contact with Tahir– this is a politicians answer, IT IS NOT THE ANSWER TO THE QUESTION "IS TAHIR INVOLVED WITH AGA AGAIN"?? A FINAL SAYING"LEOPARDS DO NOT CHANGE THEIR SPOTS"  We would now like to wish all AGA buyers a very merry christmas and a prosporous new year and to Ron ,Josh, Des ,Brian ,not forgetting Pat a special  thanks for everything and  have a super christmas and new year we do hope that you will continue to represent us until our properties are built and both Howard and Myself will continue to offer our full support,and if we can help in any way we will be only to willing to do so, but i cannot promise to stop asking the awkward questions     I read in the report from ABC "don t let s lose site of what has been achieved on Amaranta this year" I say ask Quinney and all the other who have still only got a base or in some cases not even that — what have they got for their money this year?? ask Bob Palmer Yellow 7– has he seen anything for all his money? I am sure there are many of the 97 going ahead could tell us what they have got this year only one more payment from the buyers to come in(maximum of £117,000) to complete the retaining/boundary walls  (oh i forgot the £934 in the bank account)   remember the amount paid for what has been achieved this year is:£1.18million. Gary has not given details of how it was spent, all we know is that £15000/month has been paid out for planning permission This is not a criticism of the members of the ABC Committee, as i have already stated they have done all they could do to get all our properties built, but they have been used by Gary Robb and badly let down by him. He has put them in the front line to be shot at and has never had the guts to publish on the BB as i asked Gary before MAN or MOUSE add another or Coward     As will the above if the questions are not answered by the Odious, Lying, Cheating Criminal –  Gary Robb

WELL AMARANTA BUYERS COMMITEE I THOUGHT WORK HAD RESTARTED AT AMARANTA 12 MONTHS AGO?  MAYBE THE THUG AND THE THIEF SHOULD HAVE SAT DOWN AND SORTED OUT THEIR DIFFERENCES FOUR YEARS AGO, AND BEING COUNTER PRODUCTIVE TO EVERY AGA VICTIM, THEIR FRAUDULENT ACTIVITIES, WOULD HAVE PREVENTED SOME OF THE DOUBLE SOLD, DANGEROUSLY BUILT, PRETEND BOXES, WHICH GAVE THE THIEF AND THE THUG MILLIONS OF POUNDS, FIRST TIME AROUND,COULD HAVE PREVENTED SOME VICTIMS CONTINUING GIVING THEIR HONEST MONEY TO THE THIEF AND NOW IT SEEM THE THUG FOR THE SECOND TIME AROUND, OR MAYBE AS HAS BE SAID TO ME THIS WEEK, MAYBE THESE VICTIMS WERE SO DESPERATE THEY FELT THEY HAD NO ALTERNATIVE! 

 

AND SO WE COME TO SERTAC (YOU HAVE RAISED THIS MATTER WITH "THE FUGITIVE”) AND "HE IS NOT AWARE OF THE RESIGNATION OF EITHER SERTAC OR KUTSEL" AND THE FUGITIVE HAS NOT BEEN ABLE TO RAISE THEM BY TELEPHONE"

APRIL WITH THE EXTENSION WILL HOPEFULLY COMPLETE ALL THE 97 PROPERTIES, SEPTEMBER/OCTOBER 2009 PROBABLY WITH AN EXTENSION WILL ALLOW FOR ALL REFUNDS TO BE MADE, AND THE FUGITIVE IS AWARE AND EVER HOPEFUL THAT THE GOVERNMENT ASSISTANCE WILL BRING MATTERS FORWARD TOWARDS A RESOLVE WITHIN THE TIME FRAME

 

I THINK THAT AMARNTA BUYERS COMMITTEE SHOULD TAKE CHRISTMAS AND NEW YEAR TO CONSIDER THE EXTENT OF THEIR FUTURE ROLE, AS WILL AGA BUYERS ACTION GROUP BUT THE LATTER ON A MORE POSITIVE NOTE.

ABC Final Report Of 2008

 

Firstly a quick update on this weeks progress at the valley.   Steel has been moved from the entrance to the site down to where progress is being made on the cages for another footprint in the Red Section and stone has been positioned where required for the stone workers.  Work has continued with the huge 15 to 18 foot high retaining wall at the far end of Red Section and around the corner into Phase 2 as well as for the footprint for the next section.   Steel and shuttering has been put into place and the work on both is now complete.   We have just returned from the site where upon speaking to the workers there we were informed that concrete has been ordered and will be poured this afternoon.    It is obviously going to take a very great quantity of concrete to make this wall and the follow on.    Boundary wall workers who should have returned to work this week are arriving back today and we were told that they would be back to work this afternoon.   The JCB is in action and will be digging out footings for further retaining walls as well as moving materials around the site and back filling where necessary.

 

The goals and aims we all set out together to meet this time last year have by no stretch of the imagination been met.   Many, if not the majority, of us had high hopes that we would be spending this Christmas and New Year in our new homes but circumstances have conspired against us and we are going to have to celebrate this holiday in the same place as we did last year.   However we believe that there is light at the end of the tunnel and we remain optimistic that solutions are in hand and will be found and work will once again start in earnest.

 

Let’s not loose sight of the fact that there has been much progress at the Valley albeit in fits and starts.   Where we are now whilst not being where we would have expected to be has come a long way from the state of the site this time last year.   Things went well for the first three months of the year but it then became apparent that in the main the money available was that provided by the buyers and that was not going to be anything near to enough for the completion of the valley but we were assured by Gary Robb that he was actively seeking funding.    

 

When we started out on this process we were all unaware of the extent of the legal tangle that had been and continued to be woven and the difficulties faced in unravelling it.   We worked very hard trying to persuade Gary Robb and the lawyers to come to agreements over ways and means to resolve these problems and truly believed that the lifting of Injunctions by the means of Gary Robb giving judgements was providing the needed solution but the further actions of some lawyers in many way negated this.  What is clear is that had it not been for the legal wrangles perpetuated by lawyers which has strangled the progress we would have seen work at the Valley move on much further and faster.    However, is seems that some people could not or would not see that a solution for the Valley was a solution for the problems on other sites as a resolve for them would follow on from a successful completion of our site.   With Turk Barter on board along with Orhan and with the investors pumping in funds all of whom we are assured still wait in the wings then money could have been generated to resolve these other issues.  In addition to this had Gary Robb achieved the return of his machinery and lands in May as we were told he was promised by the AG then we would have seen him financing and running the continuation of the works.  

 

After our meeting with the Government and Lawyers in October the Government came to a decision that they must step in to some degree and they are very close to completing their plans for the Roads, Electricity and Water.  We were informed by Yonge from the PMs Office this week that she is just waiting now for KibTek to submit their plans and the government will be ready to start.   At that stage when plans and dates are received Gary and his Lawyers will be submitted them to the investors and Turk Barter and it is understood that the signs are encouraging that they will then sign up to the Valley.   We gave a list of all those properties to be completed for buyers to the KibTek on Thursday so that bodes well for further progress.

 

On the matter of finance we have received £1,181,484.00 from buyers up to the 16th December and the disbursement has been £1,180,550.00 paid out to 32 different suppliers and contractors those payments have included £150,000.00 to Catalkoy Baladeyesi for Planning Permission.

 

The year has seen one of the members of ABC resign because of the harassment we experienced from Kulakzis and another dragged into court by them on spurious and unsubstantiated charges.  We have received over 2200 e-mails and sent out 2952 (many of those to multiple addressees).  As well as the weekly buyers meetings the committee have attended meetings with Gary at least once a week and numerous other meetings with other parties including site meetings with buyers and many meetings with lawyers and government officials.   We also held weekly meeting with Kutsel and Sertac until they withdrew from the site which were in many instances not productive these meetings often ended with them promising information and plans which never seemed to appear or were not as advertised.   This was incredibly frustrating and we seemed unable to get through to them that they were working on our behalf and not the other way around.

 

Many hours and days were spent in the first half of the year contacting those buyers who had asked for a refund and obtaining information from them.   When we had completed this task and collated all the information we then passed this on to Gary Robb and his then secretary Lindsey for them to complete their action to raise and distributed the bonds.   This was over and above our remit but we felt that we must get involved if any progress was to be made for these buyers.   We understand that the majority of the bonds were sent out and with the matter now being out of our hands any unresolved issued must now be a matter between Gary Robb/AGA and the buyers themselves.

 

On the issue of Tahir it has been no secret that Gary Robb has been involved with him since early in the year trying to obtain his cooperation in the matter of the return of his Plant and Machinery and the Lands owned by Gary but held in Tahirs name.   There are also issues over HZ Omar and an Injunction on Amaranta Valley held by Tahir which needed resolve.  We are informed that Tahir does not want to obstruct work at Amaranta Valley and has agreed to lift his injunction when work is restarted.   It would have been counter productive for Gary Robb to have refused to meet with Tahir or speak to him on these matters.  

 

As far as the e-mail sent out recently by Sertac, we have raised the matter with Gary Robb who told us that he is not aware of the resignation of Sertac or Kutsel as neither of them has been in recent contact with him and he is unable to raise them by telephone.

 

The protocol comes to an end next month and with a three month extension as per our contracts Gary has until April to complete his responsibility within the protocol.   He is aware of this and very hopeful that with the Government assistance forthcoming he will be able to bring matters forward towards a resolve albeit that it seems unlikely that the site will be completed within that time frame. 

 

 

With regard to ABC’s future involvement once the protocol ends we are unsure where we will stand.   We have no intention of washing our hands and walking away from the issues and if people indicate that they want us to continue to represent their interests then we feel that we will have to consider their wishes.      The intensity of the workload and events throughout this past year has led to us all feeling mentally and physically worn out and at a very low ebb.   One of our members’ is currently in hospital undergoing a series of blood and other tests and all our thoughts are with Brian wishing him a full recovery.   We have found that trying to work and achieve resolves to any and all matters in the TRNC does not in any way resemble the simple and sensible way we would expect things to happen in the UK and that many of the normal rules of commerce and behaviour simply do not apply here.   It has also been clear that we are not party to everything that transpires and although it appears that some people think we should have a full knowledge of everything that goes on we can only report and react to what we are told or experience ourselves.  

 

Therefore, we are now going to take time out over the Christmas and New Year period to consider the extent of our future role in all these matters and whilst we will of course continue to respond to and report on any urgent matters that come up over the holiday period we are to all intents and purposes shutting down for two weeks and this will be our last formal report of 2008.

 

We would like to take the opportunity to thank everyone who has given us their support throughout what has turned out to be an incredibly eventful and stressful year for everybody concerned.   We wish you all a Merry Christmas and a Happy New Year with the fervent wish that next year will bring us our homes and see our dreams fulfilled.

Let’s hope that this committee have a good Xmas and really look to taking legal advice (British) in early 2009 in order to cover themselves and to ascertain exactly where they stand as regards as the £1.1 million having passed through their hands into Gary Robb’s, because to date not one sensible set of adopted and seconded accounts have been published and it’s only their names on the bank account !

 

Also if Gary Robb leaves ABC holding the baby they will need legal rep.

 

Why ?, because there will be 97 AGA victims who signed the protocol with the hump and another £1.1 million out of pocket – and especially as they have been asked the same questions time and time again, but they have not answered one of them !

 

Shame that no one has really grasped the fact that Tahir & Gary are really best mates and have engineered the whole scam

 

Perhaps some people should take time to listen to the infamous CD handed to us by Cafer Gurcafer in March 2006 – After all the contents on the CD have now become a stark reality !

There are NO answers to questions posed to the Amaranta Buyers Committee from concerned victims who signed the protocol, yet they have now allegedly had £1.3 million pounds pass through their hands on its way to Gary Robb.

 

The reason I say pass though their hands is because the law will see it that way. They have their names on the bank account to which the victims money was paid, so therefore in the eyes of the law (British anyway) they will allegedly held responsible unless they have unadulterated proof that they passed the money to suppliers and to Gary (which I am sure they have). They will need cast iron receipts for all of this money or they could find themselves in the proverbial mire !

 

Just the occasional statement that  “we are building walls “ will not suffice. As a committee they will need to provide accounts, minutes, plans, receipts so on and so forth all adopted and seconded by the members. This is a legal requirement !

 

The non or rather evasive answers to important questions posed by victims is also worrying – come on ABC put the victims minds at rest – get real answers to these questions !

Gary Robb is allegedly no longer at Rafters having a few drinks with these Ex-Pats and laughing at the AGA victims (we have emails to confirm this) but as we predicted some months ago – Gary Robb will allegedly now be laughing at them !  This is the way Gary Robb works. He will use people until they are no longer of any use to him and them they will be chucked on the scrap heap along with those before them without a lifeline nor a leg to stand on.

Not an interesting email from us, just a link to this blog  and an offer of support if we can. The email doesn’t really concern just the protocol, rather just pointing out that what we were told in the TRNC in August 2007 has somewhat come to fruition and that it allegedly appears that Gary Robb may have got away with approx another £1.3 million – just our opinion, but it doesn’t seem like Gary Robb is going to fill the shortfall needed to finish his projects (a minimum of £11 million or so – all sites) and it also is blatantly obvious that he will not be facing the responsibilities of his current court cases & judgements thus leaving all injunctions and memorandums in place. The courts will not lift them.

 

We are aware of one purchaser who has an injunction absolute covering 33 donums at Amaranta ! Makes our injunction absolute which covers the whole of the Green section look insignificant. So, unless Gary does find a swift solution for these people – Amaranta Valley is going nowhere.  There are at least 16 injunctions covering Amaranta Valley along with a number of memorandums (that we know of) and these will no be lifted until Gary faces his responsibilities and satisfies these issues

 

As AGA victims once again face the stark realisation that their houses may not be finished in the foreseeable future then the amount of court cases against Gary Robb will surely increase thus making the web stickier and bigger than ever
