North Cyprus Property Problems | Tsimpedes Law

When we think of Amaranta Valley we immediately think of Gary Robb. A man whose presence in the TRNC caused havoc in the lives of his many innocent victims. A man on the run from the British legal system where he was charged with drugs related offences. A man who was made welcome in this country and was even allegedly given/bought Citizenship. A man, who in partnership with local ‘respectable’ business men formed a company called Aga Development Limited, the company allegedly named after Mr. Robb’s wife Aga who still enjoys life here with her children in her allegedly unencumbered luxury home.

The ‘Aga Saga’ is well known on this island, the primary character who after having wreaked havoc here was eventually extradited back to Britain, tried, found guilty sentenced and after serving that sentence extradited to the Republic of Cyprus to face a long list of charges, the primary one being that of building on Greek owned land. Because he was ‘helpful’ and ‘contrite’ he received a very short sentence in the RoC, less than a year and will soon be free. His wife has allegedly claimed that he too is a ‘victim’, but I think those of us touched by the many property ‘scams’ here in the TRNC see Mr Robb for what he a really is, a victim of his own greed. A Rob(b)in Hood in reverse, who stole from the poor to give to the rich.

Through his property company Mr Robb has systematically taken the life savings of so many hapless purchasers, who dreamed of a home/retirement home in the sun and believed their Advocates were acting in their best interest, protecting their interest and indeed even believed that it was safe and legal to purchase a home in the TRNC. He has asked for more money, and indeed has been given it by some. He allegedly even sent a letter whilst in the British prison outlining his plan to finish the homes of his victims, this of course entailed them parting with more money.

Mr Robb’s victims, who numbers several hundreds, have found no help in the TRNC. Some have taken legal action, some have petitioned the government, all to no avail.

Now having exhausted all the avenues in the TRNC a group of Aga purchasers are pursuing justice through the American Court system. However, this is not just open to Aga victims but to any victim of the property scams here in the TRNC. It is well known that Kulaksiz 5 have chosen to submit a case to the European Court of Human Rights but their case will not continue in earnest until all the domestic cases they have here have failed and, looking at the progress here this far, they seem doomed to have to look to the ECHR for justice. As most of you know, I personally won my Breach of Contract case against Kulaksiz but that was over two years ago and I still have no compensation and now, no villa. For this reason I was allowed to join the joint Kulaksiz 5 cases.

There is no reason why anyone in a similar position to me could not join the American case and whilst I am not giving an opinion, one way or the other, I have attached the link to the Retainer for this case for everyone’s information.

My understanding is that anyone can join in the case, a fee of $300 American dollars would be the only capital outlay. It is a No Win, No further fee situation, but in the event of winning, you will pay 25% of the compensation to the lawyer. Maths has never been my strong suit, but 75% of something sounds better than 100% of nothing to me. It would of course be a very personal choice.

Would I take that route? I really do not know.

In conclusion,  we cannot guarantee this will be a success, but after the last six years of being ignored, scammed, lied to and pushed from pillar to post this looks to be our best avenue of approach so far and we as ABAG are prepared to give it a chance especially after the Orams losses.

RETAINER AGREEMENT

  

I, __________________, hereinafter referred to as the Client, agrees the TSIMPEDES LAW FIRM (hereinafter “FIRM”), shall represent the Client in connection with recouping monies paid towards a fraudulent property scheme by the TRNC, Republic of Turkey and other parties to be filed in the Washington, DC USA under the following conditions:

 

[1]       SCOPE OF REPRESENTATION

The FIRM shall represent the Client only for the purposes mentioned above including filing suit and litigation at the trial court level only.  This representation does not include any appeals that may be required. However, if an appeal is requested by the Client, The Tsimpedes Law Firm will appeal the case for the amount of $2,500 excluding the costs of transcripts or court fees necessary that the Client agrees to pay from the gross recovery. Client agrees this matter may be filed as a class action or joined with others in a lawsuit who have similar claims (as defrauded buyers of TRNC property) and shall fully cooperate with the FIRM at all times. 

[2]       COMPENSATION

Under this contingent fee agreement, the Client shall pay the FIRM compensation as follows:

1.         An administrative fee (non expense) in the amount of THREE HUNDRED DOLLARS ($300.00);   The low fee contemplates that hundreds will participate to make this lawsuit viable to pursue.  Should there not be a substantial number joining in this lawsuit that makes it impractical to file the lawsuit, the Tsimpedes Law Firm will either refund your $300.00 or allow you other legal options to pursue at your discretion.

2.         Contingency.    Client agrees to pay the FIRM attorney fees on a contingency basis as follows: TWENTY-FIVE (25%) of the gross recovery, judgment, settlement, award or other value received (the amount recovered prior to any expenses incurred by the FIRM being deducted) obtained for the client in any recovery, award, judgment, settlement or other value received (collectively referred to as the “recovery”). 

 

[3]      EXPENSES AND COSTS.     

The Client shall be liable for expenses and attorney’s fees only to the extent of any recovery made and if there is no recovery, then the Client shall not be responsible for the payment of any expenses and attorney’s fee whatsoever.  Such specific costs for which the Client may be charged, include, but are not limited to, the following:  long distance telephone calls, local and out of town transportation, out of town food and lodging, messenger deliveries, overnight mail, multiple photocopies, transcription fees, agency assessed fees, specialized research materials, expert fees and the like.

 

The Client agrees and understand that he/she is participating in a lawsuit with other AGA Buyer Group members or other defrauded buyers of Property in the TRNC who have been fraudulently induced by the TRNC of their money and will share in the costs and expenses on a pro rata basis.  This also requires Client to share evidence and discovery with each other in such cases only.  Unless indicated herein, The Firm will not disclose any information to third parties (other than buyers of TRNC property who have filed lawsuits by the Tsimpedes Law Firm) unless the client provides permission or has provided such information in the public domain.

 

If the FIRM obtains a settlement offer which the client rejects, then, should the Client settle on his/her own or retain other counsel and achieve a settlement or win a verdict, the FIRM shall be entitled to the same fee as had the client accepted the earlier settlement offer obtained by the FIRM.

 

Client agrees and understands this he/she does not seek title to property in the north of Cyprus but only the return of the monies paid or other compensation allowed by law.  The representation provided by the Tsimpedes Law Firm is for compensation only.

For those amongst us who do believe in ‘poetic justice’, you will glad to hear that a reliable source has revealed that Mavis Robb, mother of the well known property developer Gary Robb of Amaranta Valley and Aga Development fame, has now been evicted, furniture the lot, and the property is now the legal possession of the original landowner. When I say legal possession, I mean it literally, my source tells me, he now has full access to it.

The really good news to accompany this is that it would appear all the other owners there seem to be well on the way to achieving not only justice, but also their title deeds. I am a great believer in the old saying, it ain’t over until the fat lady sings, well in the case of Mrs Robb, I think the fat lady is in full voice, the legitimate purchasers, I will keep everything well and truly crossed. I cannot imagine having been so unceremoniously escorted from this island, Mrs Robb would have any wish to return, and I am not sure the status of her exit would allow for her return anyway.

With the RoC now about to start the ‘auction route’. I cannot envisage many potential purchasers will be putting either side of the island of Cyprus on their list of ‘potential retirement home destinations.’ It would also seem that both sides are totally unwilling or unable to get to grips with the reality that in allowing this situation to continue they not only damage their credibility as an ethical place to invest, are causing their construction industry damage but also turning themselves into a very unnattractive holiday destination. Where will this all end. Who knows, but clearly the end is nowhere in sight
