2 years ago we received the following letter after a meeting with Andrew Duff. At the time he asked us to keep the letter private……dunno why, so now we are printing it…..nothing has changed even with the intervening of an MEP
First, thank you for coming to see me in Cambridge and for keeping me in touch subsequently with the latest twists and turns in your court battle. I look forward to hearing news of the outcome of the hearing on 4 December in which it would be good to learn that the TRNC authorities have moved against AGA.
Second, I can clarify the standing of the TRNC in EU law, as you request. The whole of the island of Cyprus has joined the European Union in 2004, but the acquis communautaire — that is, the body of EU law that flows from membership — is suspended in the North. In practice this means that although a Turkish Cypriot is regarded as an EU citizen, litigation regarding the territory of the island outside the effective control of the (Greek Cypriot) Republic of Cyprus is not recognised by the EU as such. Unfortunately, therefore, neither the European Court of Justice nor the European Commission can join in such cases as yours to ensure that EU norms with respect to property disputes are applied.
Third, I was on the island last week and held extensive talks with both President Talat and Prime Minister Ertoglu. Both are fully aware of the sensitivity of the current clutch of court cases from mostly British and German citizens concerning property speculation in the TRNC. But their present preoccupation is the state of negotiations between them and the Greek Cypriots. These talks really dominate the agenda to the exclusion of all else. The settlement of property disputes plays a key part in these negotiations, the deadline for which is March.
Frankly, I do not believe that it will be possible to expect much more of the TRNC authorities in enforcing the better administration of justice and in combating international organised crime in the absence of a comprehensive settlement of the constitutional problem on the island. I am sorry not to be more encouraging, but we will keep these matters in general, and your own case in particular, under close review as things develop in the next few weeks.
I have great sympathy for your plight, and am sorry that it does not appear possible at present to do more to help.
