Four arrest warrants issued over developments in north

POLICE yesterday issued European arrest warrants against three Turkish Cypriots and one British national for using occupied Greek Cypriot property, but it remained to be seen how and whether the court summons would be served in the north after authorities warned last week that anyone attempting to do so would be arrested.

One of the four warrants was against Mark Unwin, a British national, a real estate agent charged with developing land plots near Kyrenia belonging to Greek Cypriots Christos Mazios and Georgios Iacovou. Apparently the land was used to build tourist apartments

Meanwhile arrest warrants were issued for three Turkish Cypriots, owners of a company that erected a building complex in thevillageofKazafani, just south of Kyrenia.

Reports said yesterday that, at least in some of the cases, police took this action on its own initiative, without the affected parties filing suit.

A BRITISH criminal currently serving a prison sentence for drug dealing in the UK will soon be extradited to Cyprus to face accusations of developing and trading in Greek Cypriot properties in the north, the British Crown Prosecution Service (CPS) confirmed yesterday.

It will be the first time the Cyprus government has brought a case in Cyprus against an individual for the illegal development of Greek Cypriot property in the north.

Forty-eight-year-old Garry Robb, who escaped to northern Cyprus after being released on bail for drug dealing in the UK in 1996, will be re-arrested and deported to Cyprus on July 13 – immediately after he is released from jail in Britain, the CPS told the Cyprus Mail. After 13 years of hiding out in the north, Robb was sentenced to five years when recaptured in January 2009, but will be released on parole next month.

Before his recapture by British police in 2009, Robb established AGA Developments, a property development company that allegedly lured hundreds of unsuspecting Britons into investing in villas and apartments built on Greek Cypriot-owned land in the north. British police believe around 400 Britons collectively lost in the region of 35 million UK pounds in deals with Robb’s AGA Developments. AGA’s notorious Amaranta Valley project located close to the north coastal village of Klepini still consists of 500 rapidly decaying half-built properties.

According to information provided by the CPS yesterday, the European Arrest Warrant (EAW) charges Robb with nine offences and states that “between 2004 and 2005, the defendant conspired with others (named as Tuncel Tahir Soycan and Akan Kursat Talat) to develop land which did not belong to them, and to sell villas built without permission upon that land by means of false representations to the prospective purchasers”.

All cases against Robb refer to properties he sought to develop in the Kyrenia district and “concern the fraudulent sale or offering for sale of villas on the illegally-developed plots of land”.

Two other charges cited in the EAW accuse Robb and his compatriots of conspiracy to commit a felony and conspiracy to commit a misdemeanour. All the alleged offences are believed to have occurred between April 2004 and April 2005.

If Robb does appear in a Cyprus court, Greek Cypriot judges will not however be focusing on the losses of unsuspecting Britons, but on the losses of the Greek Cypriot landowners whose properties he dealt in.

As Greek Cypriot lawyer Constantis Candouna told the Cyprus Mail yesterday, “It is the Greek Cypriot refugees who are the victims. For the Brits, it was as if they were buying stuff off the back of a lorry”. He advised Britons who had been cheated by Robb to apply to courts in the UK or the north.

European arrest warrants for Robb and his two AGA associates Tahir Soycan and Akan Kursat were first issued in 2005 by a Nicosia court amid allegations the three were trading in illegally acquired Greek Cypriot properties in the north. Turkish Cypriot police however did not act on the warrants because the territory remains outside EU jurisdiction, and because its authority did not view Robb’s selling of Greek Cypriot property a crime. Britain, it seems, has waited for Robb to serve his sentence for drug dealing before deciding to enact the EAW.

My article yesterday was carefully worded for very good reason. I have now received a reply from the CPS Press Office.

“Your email below was passed on to press office for a response as we deal with media inquiries of this nature. Police and the CPS do not confirm whether arrest warrants have been issued in extradition cases until the persons named in the warrants are in custody and appear before the court.

I can therefore only confirm that the City of Westminster Magistrates’ Court has ordered the extradition of Gary Robb on June 13, 2011. You will need to speak to the police in Cyprus about the two others named in your email.

The European Arrest Warrant relates to nine offences of which the defendant Gary Robb is accused. The alleged conduct may be summarised as follows: between 2004 and 2005, the defendant conspired with others (named as Tuncel Tahir SOYCAN and Akan Kursat TALAT) to develop land which did not belong to them, and to sell villas built without permission upon that land by means of false representations to the prospective purchasers. The land in question is situated in two localities; Franga and Paliomantra. These are areas within Kyrenia district in the occupied territory of northern Cyprus

The development of this land without ownership or permission forms the basis of charges under Cypriot law of (i) criminal trespass; (ii) illegal possession, cultivation, enjoyment or use of land; and (iii) malicious damage on trees.

The second aspect of the case concerns the fraudulent sale or offering for sale of villas on the illegally-developed plots of land. These fraudulent sales and offerings for sale are reflected in charges under Cypriot law of (i) obtaining goods by false pretences; (ii) fraud on the sale or mortgage of property; (iii) attempting to obtain money by false pretences; and (iv) money laundering.

The remaining two charges cited in the EAW are offences of conspiracy, namely (i) conspiracy to commit a felony and (ii) conspiracy to commit a misdemeanour.

The fraud is alleged to have occurred between April 2004 and April 2005. The contracts of sale entered into totalled £1.2m. We don’t have details of the investors and none were given in court.

It would appear that no-one, not even the Sunday People have a definitive answer as to whether two further European Arrest Warrants have been requested or issued, which would explain why there was no mention of them in yesterday’s article. So the mystery continues, but not for too long if the other enquiry I have put out bears fruit

NORTH CYPRUS – WE ENTER OUR EIGHTH YEAR OF THE AGA SAGA

Today we enter our eighth year of the AGA SAGA nightmare.

To date we are no further forward. We have been offered a judgement against Robb, but due to a new contract law bought in a number of years after we originally signed our contract it appears we have to pay a further £1500 to get the judgement enforced.

Why have we not done this you may ask?   Well for us it’s not financially possible and to date no judgements against Robb have ever been enforced, so we would be throwing more money after bad and let’s face it who in our situation would spend a further £1500 in this corrupt country. If our lawyer Gurkan had thought we would have had a chance of winning he would have taken up our offer of paying the monies to him plus interest when the case was settled and lets face it what TRNC lawyer would turn down easy money, lets face it they made a mint out of AGA victims as it is. So we are in a stalemate as regards the TRNC.

We have been made aware the Unwims took £4000 commision for the sale of our non existant property, would it put them in a good loght if they offered it back.

There are many rumours regarding the auction of AmarantaValley, but there are so many injunctions and memorandums on the site there would be no monies available to pay back what is owed to the victims.

We as ABAG have met so many ministers of the government and followed so many paper trails, each one ending in a brick wall when you ask for answers to questions. To date not one of our officially delivered questions has ever been answered by either the TRNC orTurkey.

Robb is due to be released from jail shortly and the rumour is that there is a warrant for his extradition to theRepublicOfCyprus, time will tell. Robb is still a financial psychopath and if he had an ounce of conscience he would pay back his victims from his ill gotten gains which we believe are spread throughout the world

We and a number of other victims have aided the Serious Organised Crime Organisation of stopping Robb from getting back the £1.6 million which was seized in about 2006. £1.6 million that he was transferring from the TRNC toThailand. This is ongoing through the courts and therefore we are unable to say more apart from that it has been proven whose money it is and hopefully one day these victims will be recompensed by our government and SOCA,

We are still in the process of issuing a lawsuit through the courts inWashington DC and as each day passes more and more evidence of HSBC,Turkey and the TRNC assisting in allegedly laundering monies comes to light. The case is huge and time will tell which way it will go.

There have been many sad deaths of victims since this debacle started and we send our condolences to all those who have suffered sad losses. This makes us stronger in the mindset that we will not give up, nor will we go away. Robb may be free from jail but he will never be free from those compatriots of his whom he has stolen from.

Robb, don’t know if you read this but,  your Karma must be pretty sh*t and remember what goes round comes round or perhaps should we appeal to your better nature (if you have one)
